Before you begin using RecCloud VoiceCap and its related services, please carefully read and understand all terms, particularly those concerning rights and obligations, liability limitations or exemptions, applicable laws, and dispute resolution. Your attention to these terms is crucial.

Confirmation and Acceptance of Terms

RecCloud VoiceCap and its related services (hereinafter referred to as “RecCloud VoiceCap” or “the Service”) are owned and operated by Wangxu Technology Co., Ltd. and its affiliates (hereinafter referred to as “the Company”).

If you are under 18 years old, or classified as a minor under applicable laws (such as children under 13-16 years old according to the GDPR and EU regulations), it is essential that you read and understand these terms with the help of a guardian and use this software only with their consent.

For any questions, comments, or suggestions regarding these terms, please contact us at https://reccloud.com/contact. If you do not agree to these terms, you will be unable to access all features of the software, and we encourage you to discontinue use. By explicitly agreeing to these terms and continuing to use the software, you accept all conditions outlined herein.

The Company reserves the right to change, modify, add, or remove parts of these Service Terms at its discretion. It is your responsibility to regularly review the Terms for updates. Continuing to use the service after changes indicates your acceptance of those changes. If you do not agree, please cease using the service immediately.

You acknowledge and agree that the Company may suspend, interrupt, or terminate all or part of the services due to business decisions, government actions, force majeure, or other reasons. In such cases, we will provide reasonable notice within a suitable timeframe. Unless otherwise specified by law, the Company shall not be liable for any losses resulting from such actions.

Registration and Account Management

You can register for an account and use the software by selecting the appropriate option on the login/registration page. Upon successful registration, you will receive a unique user ID to identify your account. Please note that if you register multiple accounts with RecCloud VoiceCap, these accounts remain separate unless you choose to bind them.

Your RecCloud VoiceCap account is for personal use only. You are solely responsible for the authenticity, legality, and validity of the registration information you provide. Your account nickname, avatar, and related details must not contain any illegal or inappropriate content. Malicious registration, including frequent or bulk account creation, is prohibited. The company reserves the right to review your registration information.

Ownership and related rights of your RecCloud VoiceCap account belong to the company. After registration, you only have the right to use the account. You may not gift, borrow, rent, transfer, sell, or allow others to use your account without written consent from the company. If the company suspects that the user is not the original registrant, it reserves the right to suspend or terminate services without notice and may permanently disable or cancel the account without liability.

You have the right to delete your RecCloud VoiceCap account through the following methods:

  • Web: Click on your avatar → My Account → Settings → Delete Account.
  • App: Tap on Me → Avatar → Delete Account.

You may also contact RecCloud VoiceCap staff for assistance with account deletion. Please be aware that account deletion is irreversible, all data and information will be permanently lost. You are responsible for all actions taken prior to account deletion.

User Code of Conduct

You must not interfere with or disrupt the normal operation of this service without authorization. This includes, but is not limited to:

  • Using unauthorized plugins, cheats, systems, or tools.
  • Employing automated scripts (e.g., bots, spiders) to interact with the software.
  • Excessively consuming system or network resources, thereby affecting other users.

You are prohibited from creating, uploading, copying, publishing, transmitting, or reproducing the following content using RecCloud VoiceCap:

  • Content that incites ethnic hatred or discrimination.
  • Rumors that disrupt social order or stability.
  • Obscene, pornographic, violent, or crime-related material.
  • Insulting or defamatory content infringing on others' legal rights.
  • Content harmful to minors.
  • Commercial advertisements or spam.
  • Any content prohibited by laws or regulations.

You must not engage in activities that compromise computer network security, including:

  • Illegal network intrusions or data theft.
  • Providing tools for harmful network activities.
  • Assisting individuals in compromising network security.
  • Unauthorized access to public networks or systems.
  • Disrupting the normal operation of RecCloud VoiceCap or spreading malicious software.
  • Reverse engineering or attempting to access the source code of RecCloud VoiceCap.
  • Engaging in any illegal activities or those that infringe on the rights of others.

You are also prohibited from using RecCloud VoiceCap to distribute:

  • Content that violates local laws or regulations.
  • Political propaganda or sensitive information.
  • Obscene or criminal content.
  • Information that undermines Internet security or public morality.

You must not facilitate the distribution of non-compliant information, including setting up URLs or banner links.

While RecCloud VoiceCap strives to ensure the security of your data, it cannot guarantee absolute protection, especially in cases of data deletion or failure caused by factors beyond its control.

  • RecCloud VoiceCap is not liable for any deletion or storage failure of your data in this software due to reasons beyond its control.
  • You are responsible for backing up your data and information stored on this platform, unless otherwise specified.
  • If you choose to stop using RecCloud VoiceCap and delete your account, all your data and information will be permanently deleted and cannot be recovered.
  • For free users (including those with expired memberships), if you do not log into your RecCloud VoiceCap account for 1 month, all your AI usage information and audio/video data will be permanently deleted and cannot be recovered, however, your account will still be retained.

Personal Information Protection

RecCloud VoiceCap’s “Privacy Policy” (https://reccloud.com/privacy) is a fundamental document that underscores our commitment to protecting your personal information and privacy. We encourage you to review the detailed terms to ensure your legal rights are safeguarded.

RecCloud VoiceCap may collaborate with other companies or software providers. We will not share your personal information with third parties without your explicit consent and confirmation that they uphold the same level of privacy protection as RecCloud VoiceCap.

Service

You can download the appropriate version of RecCloud VoiceCap from the official RecCloud VoiceCap platform, authorized websites under Shenzhen Wangxu Technology Co., Ltd., or approved third-party platforms. However, if you download or use RecCloud VoiceCap or similar software from unauthorized sources, we cannot guarantee proper functionality and will not be liable for any resulting losses.

RecCloud VoiceCap offers different service versions tailored to your needs. You can choose to use the free service or opt for a membership service upon payment of the membership fee.

To enhance our services, RecCloud VoiceCap may adjust the prices of paid services periodically and introduce new fees for specific features, reflecting changes in commercial or legal regulations. Specific service prices will be displayed on the RecCloud VoiceCap member payment page. We will make every effort to notify you in advance of any price changes through various channels (including our official website). Unless otherwise stated, price adjustments will apply to the services purchased after the current billing cycle ends and will take effect at the next payment.

If you do not agree with the new prices or fees, you can opt out of the paid service. If you have selected automatic renewal and agree to the new charges, you must follow the instructions in the notification to confirm your acceptance of the adjusted fees before the next billing cycle. Failure to do so will result in your paid service being converted to the free version at the end of the current billing cycle, terminating automatic renewal.

Intellectual Property

All intellectual property rights to the content provided by RecCloud VoiceCap, including but not limited to software, web pages, text, images, trademarks, and audio/video materials, belong to us. Unauthorized use, including monitoring, copying, distributing, or displaying this content, is prohibited.

You may not use any trademarks, service marks, trade names, or distinctive brand features of the company, including “RecCloud,” “reccloud.cn,” “reccloud.com,” ”VoiceCap,” and “网旭,” without prior written consent. Unauthorized use may result in legal liability for any losses incurred by the company or others.

Terms of Use for Minors

If you are a minor under 18 or considered a child under applicable laws (such as those under GDPR in the EU), you must read this agreement carefully with your guardian and only use this software with their consent. If you do not have your guardian's consent, they have the right to manage your account through RecCloud VoiceCap’s contact information.

You and your guardian acknowledge that if you violate any laws while using this software, both you and your guardian will bear all legal responsibilities.

You and your guardian also understand that using this software may involve paid services. Please ensure that your guardian manages their payment methods and accounts responsibly to prevent unauthorized charges.

Limited Liability and Disclaimer

You acknowledge that RecCloud VoiceCap does not guarantee:

  • The software and services will fully meet your needs or expectations.
  • There will be no interruptions in the software and services.
  • Any errors will be corrected.

If you download or use RecCloud VoiceCap from unauthorized sites, we cannot ensure proper functionality and will not be liable for any resulting losses.

In cases of force majeure—such as natural disasters, wars, or government actions—RecCloud VoiceCap is not liable for any damages caused by interruptions or defects in the software and services. However, we will make every effort to mitigate such damages.

Our services may contain links to third-party websites that we do not control. We are not responsible for their content, privacy policies, or practices. You navigate these sites at your own risk and should review their terms and policies.

You can cancel your subscription to paid services at any time, whether or not you choose automatic renewal. Cancellation will take effect at the end of the current billing cycle, and no refunds will be issued for fees paid.

Breach of Responsibility

If you violate this agreement or any other terms with the company, we reserve the right to take actions such as issuing warnings, halting information transmission, deleting content, restricting account functions, or terminating services, depending on the severity of the violation. We will not be liable for any consequences arising from your inability to access your account or related services. The company will announce the outcome of any actions taken and may decide whether to restore account access based on the situation.

For suspected illegal activities, we will maintain relevant records, report to authorities, and cooperate with investigations. We reserve the right not to restore any deleted content.

If your violation leads to complaints or litigation from third parties, you are solely responsible for addressing these issues and bear any resulting legal liabilities. If your actions cause the company to incur losses or penalties, you must fully compensate the company for those losses.

The company respects users' rights, including intellectual property, reputation, privacy, and other legal rights. You guarantee that your use of RecCloud VoiceCap will not infringe on these rights of any third party. If we receive notice of an infringement, we have the right to remove the content in question. You are responsible for any claims made by third parties regarding rights and must bear all associated legal responsibilities. If your actions result in losses to the company, you will be required to compensate for those losses.

Other Terms

If any provision of this agreement is found invalid or unenforceable, the remaining provisions will still be valid and legally binding.

RecCloud VoiceCap may modify any part of this agreement in response to changes in laws, regulations, or operational needs. If changes occur, we will prominently notify you, and continued use of the service indicates your acceptance of the updates. If you do not agree with the changes, you may stop using the services.

This agreement is legally binding between you and the company regarding your use of the service. The effective date is as stated; if not specified, it will be 7 days after it is published online. The agreement takes effect once you click "agree" (or equivalent) on the page, with the exact time recorded by our system.

Even if you do not explicitly agree, the following actions will be considered acceptance of the terms:

  • Logging into the service.
  • Using the service.
  • Using any products or services provided by the company or third parties in connection with the service.

The interpretation and enforcement of this agreement are governed by the laws of the People's Republic of China. In case of disputes, both parties will attempt to resolve them amicably. If negotiations fail, you agree to submit the dispute to the Hong Kong International Arbitration Centre (HKIAC) under its rules, with the arbitration decision being final and binding.

Headings in this agreement are for convenience and do not affect interpretation. Any unaddressed content does not imply the company's waiver of rights.

For clarity, this agreement will be available in multiple languages. In case of discrepancies, the English version will prevail.
